Terms of Service — KOKOLOGY

These Terms of Service ("Agreement") govern your use of kokology.ca ("Website") and all related products and services (collectively, "Services"), operated by KOKOLOGY, a division of Koko Koaching Inc. ("KOKOLOGY", "we", "us", or "our"). By accessing or using our Website, you agree to be bound by this Agreement.

Section 1 — Agreement

This Agreement is legally binding between you ("User", "you", or "your") and KOKOLOGY. If you are accessing the Website on behalf of a business or legal entity, you represent that you have the authority to bind that entity to this Agreement. If you do not agree to these terms, you may not access or use the Website or Services.

Section 2 — Accounts & Membership

You must be at least 13 years of age to use our Website and Services. By creating an account, you are responsible for maintaining its security and for all activity that occurs under it. Please notify us immediately of any unauthorized access or security breach at support@kokology.ca. We reserve the right to suspend or terminate accounts that violate this Agreement or that may damage KOKOLOGY's reputation or goodwill.

Section 3 — Links to Third-Party Resources

Our Website may contain links to third-party websites or applications. These links do not imply endorsement or affiliation. KOKOLOGY is not responsible for the content, products, or practices of any third-party resource. Accessing third-party links is done at your own risk.

Section 4 — Intellectual Property

All trademarks, logos, graphics, and content associated with KOKOLOGY and its Services are the exclusive property of KOKOLOGY or its licensors. This Agreement does not transfer any intellectual property rights to you. You may not reproduce, distribute, or use any KOKOLOGY intellectual property without express written permission.

Section 5 — Disclaimer of Warranty

The Website and Services are provided on an "as is" and "as available" basis. KOKOLOGY expressly disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Your use of the Services is entirely at your own risk.

Section 6 — Limitation of Liability

To the fullest extent permitted by applicable law, KOKOLOGY and its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Website or Services. Our total aggregate liability shall not exceed the greater of one dollar (CAD $1.00) or the amount you paid to KOKOLOGY in the one-month period preceding the event giving rise to the claim.

Section 7 — Indemnification

You agree to indemnify and hold harmless KOKOLOGY and its affiliates, officers, employees, and agents from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use of the Website or Services, your content, or any willful misconduct on your part.

Section 8 — Dispute Resolution

This Agreement is governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict of law principles. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Alberta. Any claim must be filed within one (1) year of the event giving rise to the claim.

Section 9 — Changes to This Agreement

We reserve the right to modify this Agreement at any time. Updates will be posted to this page with a revised date. Continued use of the Website following any changes constitutes your acceptance of the updated terms.

Section 10 — Acceptance

By accessing and using our Website and Services, you confirm that you have read, understood, and agree to be bound by this Agreement.
